Q. Can my employer fire me for making a Workers' Compensation claim?
Maybe. It is unlawful for your employer to fire you just for seeking Workers' Compensation
benefits. In addition, it is unlawful for your employer to harass or otherwise discriminate
against you for doing so. However, an employer is permitted to fill a vacant position and
may not have an opening when you recover from your injury. The rights and duties of the
employee and employer may be covered by a written company policy, contract, collective
bargaining agreement or even by Labor Laws separate from the Pennsylvania Workers'
Compensation Act.
